Terms of service

These terms explain what SmartBESO does, what you can expect from a study and what we need from you for it to go well. We have written them to be understood.

1. Who we are

SmartBESO is a service of HOLDING NEXT TRADING TRACE CAPITAL, S.L. (Tax ID B23921513), with registered address at Llull 321, 08019 Barcelona, Spain, and contact email info@nxtecnics.com. Full details are in the legal notice.

2. What the service is

SmartBESO analyses a company’s electricity consumption curve and estimates whether installing a battery energy storage system (BESS), with or without associated renewable generation, makes economic sense. The result is a sizing study that includes a proposed power and capacity, an estimate of savings and some profitability indicators.

The service is aimed at companies and professionals. It is not a consumer service and is not intended for private individuals.

3. Your account

You can request a study without an account, but to follow its status and retrieve your reports you need to register. By doing so you undertake to provide truthful data and keep it up to date.

The account is personal. You are responsible for keeping your password safe and for the activity carried out from your account. If you suspect someone has accessed it, let us know as soon as possible.

To activate the account you need to confirm your email address through the link we send you. You can close your account whenever you wish by writing to us.

4. What we need from you

The quality of the study depends directly on the quality of the data you give us. By using the service you undertake to:

• Provide supply and contract data that match reality.
• Upload consumption curves that come from the supply you want to study, obtained from your distribution company, your retailer or your own metering system.
• Be entitled to provide us with that information. If you act on behalf of a third party, have their authorisation.
• Not use the service for purposes other than assessing real projects.

A wrong input carries through to the result. If we detect inconsistencies we will point them out, but it is not always possible to detect them.

5. About the results

A SmartBESO study is a simulation. It works with your historical data and with assumptions on prices, equipment costs, performance and regulatory conditions that we take from official sources and update periodically.

That means two things. First, it serves very well what it is designed for: understanding the order of magnitude, comparing alternatives and deciding whether it is worth going ahead with a project. Second, the results are not a promise of savings or a guarantee of profitability: the real behaviour of an installation depends on how energy prices, regulation, your own consumption and the technical execution of the project evolve.

That is why the study does not replace an engineering project, a financial analysis or the professional advice you may need before investing. Before making an investment decision, market figures, auctions, remuneration and regulatory conditions should be checked against the official sources in force, and the sizing should be validated with an installer or an engineering firm.

In other words: we give you the best estimate we can with the information available, and the decision remains yours. We are not liable for the investment decisions you make or for differences between what was estimated and what finally happens, without prejudice to our liability in cases where the law does not allow it to be limited.

6. Use of automated tools

To interpret the curve files you upload we use, in addition to our own processes, automated processing tools based on artificial intelligence. They are used to recognise the file format and organise the data, not to make decisions about you: the calculations and the result of the study are produced by our calculation engine. You can see the details in the privacy policy.

7. Price

The sizing study requested through this website is provided free of charge and with no commitment. If in the future we offer paid services, their terms and prices will be clearly stated before you contract them.

8. Availability

We work to keep the service continuously available, but there may be interruptions due to maintenance, technical incidents or causes beyond our control. Where possible we give notice of scheduled downtime.

We may modify, extend or withdraw features to improve the service. If a change affects you significantly, we will let you know.

9. Account suspension

We may suspend or cancel an account when these terms are breached, when the service is used in a way that harms its operation or that of other users, or when there are reasonable signs of fraud. Whenever possible we give notice beforehand and an opportunity to correct the situation.

10. Intellectual property

The platform, its code, its calculation models and the SmartBESO brand are ours, as detailed in the legal notice. The data you provide remain yours: we use them to provide you with the service, under the terms of the privacy policy.

The report you receive is for your internal use and that of your advisers in relation to the project assessed.

11. Data protection

How we process your personal data is explained in the privacy policy, which forms part of these terms.

12. Changes to these terms

We may update these terms to reflect changes in the service or in the regulations. The version in force is always the one published on this page, with its date at the top. If the change is substantial and you have an account, we will notify you by email.

13. Governing law

These terms are governed by Spanish law. For any disputes that may arise, the parties submit to the courts and tribunals of Barcelona, unless the applicable regulations impose another jurisdiction.
